Seminar at the CAS on IP Law offered by the ZHAW School of Management and Law

October 2024 – Our founder John Moetteli has presented a webinar entitled “USEFUL, LITTLE-KNOWN PATENT AND DESIGN STRATEGIES ONLY AVAILABLE IN THE US THAT CAN EFFECT YOUR PRIORITY FILING” for the Certificate of Advanced Studies on IP Law of the ZHAW School of Management and Law and the Swiss Federal Institute of Intellectual Property (IGE). The audience was made up of lawyers and professionals with a technical, natural science or medical background.

This webinar provided knowledge on strategies that (1) enable patent applicants to maintain trade secret rights while also preserving important patent rights and to push out costs as well as (2) how to embed several product designs into a priority application filed in Europe or elsewhere in a way which enables a patent applicant to pull these rights out in the US when they’re needed while extending their enforceable life. The participants reacted with a bit of surprise that such potentially useful strategies were possible despite international harmonization efforts. It was considered important to recognize that submarine patents cannot be found in patent search results and so one can never be completely sure of the IP cards a competitor might hold.
