Recently presented at the epi, the Institute of Professional Representatives before the European Patent Office, the Da Vinci™ Filing Strategies take advantage of the fact that the United States does not require publication of a patent application as long as it is filed only in the United States.
Trade secret and US patent rights are not mutually exclusive!
This leaves open the possibility of protecting trade secrets. Avoiding publication gives you more flexibility as to when to file your patent internationally and allowing you to postpone deadline-drive cost explosions while reserving trade secret as long as possible.
The Da Vinci™ Filing Strategies include in addition the possibility of filing what we call “UFO” designs, or “Unidentified Filed” Objects, i.e., design representations that can be incorporated into patent applications and that can be extracted from the utility application through a divisional filing, many years after the utility application is filed (but before grant or abandonment) and, once granted, are valid for 15 years from the date of grant (which can lead to extending patent protection beyond 20 years).
